These Terms define the rights and obligations of the parties in connection with the online sale of products offered by SOMNELA to its customers.

These Terms and Conditions of Sale apply to all orders placed on www.somnela.com by any individual acting as a consumer, in accordance with the provisions of the French Consumer Code.

Article 3 – Products
SOMNELA designs and sells high-end textile accessories dedicated to well-being, sleep, and hair care.
The essential characteristics of each product are presented on the product pages available on the website.
Photographs, videos, visuals, and product presentations are created with the greatest care in order to faithfully represent the products offered. However, slight differences in color, texture, or appearance may occur depending on screen settings, lighting conditions, or manufacturing processes. Such differences shall not render SOMNELA liable.
Dimensions, weights, and specifications are provided for information purposes and may vary slightly due to manufacturing processes.
SOMNELA reserves the right to modify its catalog, collections, or product characteristics at any time, without affecting orders that have already been confirmed. Markdown collé
Article 4 – Product Availability
Products are offered for sale subject to availability.
Despite careful inventory management, exceptional stock shortages may occur after an order has been confirmed.
In such circumstances, the customer will be informed as soon as possible and may choose between:
- a full refund of the amount paid;
- waiting for a restock when one is planned;
- or, where possible, an equivalent product offered with the customer’s consent.

Article 5 – Prices
Prices are stated in euros (€) and include all applicable taxes (VAT included), excluding any applicable shipping costs.
Displayed prices include VAT at the rate applicable at the time of the order.
For orders shipped outside the European Union, particularly to Switzerland or the United Kingdom, customs duties, local taxes, or import fees may be charged by the authorities of the destination country. These costs are the sole responsibility of the customer.
SOMNELA reserves the right to change its prices at any time.

Article 6 – Orders
Any order placed on the website constitutes full and unconditional acceptance of these Terms and Conditions of Sale.
Before finally confirming an order, the customer may review its details, correct any errors, and modify their cart.
The order becomes final once payment has been confirmed.
A confirmation email will then be sent to the customer summarizing the essential details of the order.
SOMNELA reserves the right to refuse or cancel any order that appears abnormal or fraudulent, or in the event of an existing dispute with the customer regarding a previous order, particularly in the event of non-payment.

Article 7 – Payment
Payment for the order is due in full when the order is confirmed.
The payment methods accepted on the website are:
- Credit/debit card (Visa, Mastercard, and other compatible cards);
- PayPal;
- Apple Pay.
Payments are fully secured using encryption technologies provided by our payment service providers.
SOMNELA does not at any time have access to the customer’s confidential banking information. Such information is processed exclusively by authorized payment providers.
An order will only be considered final once payment acceptance has been confirmed.

Article 8 – Delivery
SOMNELA currently ships to France, countries within the European Union, Switzerland, and the United Kingdom.
Orders are prepared with the utmost care and then handed over to our logistics partners.
Available shipping methods, shipping costs, and estimated delivery times are displayed to the customer before the order is confirmed. These may vary depending on the destination country, selected carrier, package weight, or any other characteristics of the order.
Delivery times are provided for information purposes only. Although SOMNELA makes every effort to meet them, they may be extended due to exceptional circumstances beyond its control, including periods of high activity, logistical constraints, customs checks, weather conditions, and similar circumstances.
For deliveries outside the European Union, particularly to Switzerland and the United Kingdom, customs duties, import taxes, or administrative fees may be charged by the authorities of the destination country. These costs are the sole responsibility of the customer.
The customer is responsible for ensuring that the information provided when placing the order is accurate. SOMNELA cannot be held liable for delays or inability to deliver resulting from an incorrect, incomplete, or inaccurate address.

Article 9 – Transfer of Risk
The risk of loss or damage to the products transfers to the customer upon actual delivery of the order to the address provided at the time of purchase.
In the event of any issue upon receipt, such as a damaged, opened, or visibly deteriorated package, customers are advised to make the necessary reservations with the carrier and promptly contact SOMNELA customer service. Markdown collé
Article 10 – Right of Withdrawal
In accordance with Articles L221-18 et seq. of the French Consumer Code, the customer has fourteen (14) calendar daysfrom receipt of the order to exercise their right of withdrawal without having to provide a reason.

The customer must then return the relevant products in accordance with the return procedure provided by SOMNELA.
Return shipping costs remain the responsibility of the customer, except in the case of a defective product, an order preparation error, or a product that does not conform to the order.
In accordance with applicable regulations, the customer is responsible for any depreciation of the product resulting from handling beyond what is necessary to establish its nature, characteristics, and proper functioning.

Article 11 – Return Conditions
To be eligible for a refund, the returned product must:
- be new, unworn, unused, and unwashed;
- be returned in its original packaging;
- include all original tags;
- be accompanied by proof of purchase.
Items showing signs of use, washing, damage, or that can no longer be resold in new condition may be refused.
For hygiene reasons, products that have been used and can no longer be resold may not be eligible for a refund, particularly textile accessories intended to be worn or used directly on the hair or face.
This restriction does not apply where the product has a manufacturing defect or does not conform to the order.

Article 12 – Defective or Non-Conforming Products
Customers are encouraged to check their order as soon as it is received.
In the event of a defective or damaged product, or if the product does not correspond to the order, the customer must contact customer service as soon as possible at:

Article 13 – Refunds
Upon receipt of the returned product, it will be inspected to verify compliance with these Terms and Conditions of Sale.
If the return is accepted, the refund will be issued using the payment method used for the original order.
Refunds are generally processed within ten (10) business days following approval of the return.
Depending on the customer’s bank processing times, a few additional days may be required before the funds appear in the customer’s account.
If a refund is refused, SOMNELA will inform the customer of the reasons for the decision.

Article 14 – Legal Guarantees
Independently of any commercial warranty that may be offered, products sold by SOMNELA benefit from the legal guarantees provided under French law.
Consumers are notably entitled to:
- the legal guarantee of conformity, provided for under Articles L.217-3 et seq. of the French Consumer Code;
- the guarantee against hidden defects, provided for under Articles 1641 et seq. of the French Civil Code.
Where a product is found to be non-conforming or affected by a hidden defect, the customer may benefit from the rights provided under applicable legal provisions.

Article 15 – Liability
SOMNELA makes every effort to ensure the accuracy of the information published on its website.
However, SOMNELA shall not be held liable in particular in the event of:
- improper or non-compliant use of the products;
- improper storage or failure to follow the recommended care instructions;
- temporary interruption of the website;
- an event beyond its control.
Photographs, videos, illustrations, and visuals appearing on the website are provided for illustrative purposes and are not contractual.

Article 16 – Force Majeure
SOMNELA shall not be held liable for failure or delay in performing its obligations when such failure or delay results from an event of force majeure within the meaning of Article 1218 of the French Civil Code.
Force majeure events include, without limitation:
- natural disasters;
- fire;
- flooding;
- pandemics or health crises;
- war;
- general strikes by carriers or postal services;
- widespread telecommunications network outages;
- administrative decisions temporarily preventing the performance of obligations.

All elements appearing on the website www.somnela.com, including:
- the SOMNELA name;
- the logo;
- photographs;
- videos;
- texts;
- illustrations;
- graphic creations;
- product descriptions;
- design elements;
- and all published content,
are protected by the provisions of the French Intellectual Property Code.
They remain the exclusive property of IJ Beauty or their respective rights holders.

Personal data collected when placing an order is used exclusively for order management, customer service, legal obligations, and, where the customer has given consent, commercial communications.

Article 19 – Consumer Mediation

Article 20 – Applicable Law and Dispute Resolution
These Terms and Conditions of Sale are governed by French law.
In the event of a dispute, the parties agree to first seek an amicable resolution.
